Freedom of Information Requests (FOIR)
Freedom of Information Requests (FOIR) in Charleston, SC
In 1966, the Freedom of Information Act (FOIA) was enacted. Its purpose is to allow for the partial or full disclosure of previously unreleased information and documents controlled by the federal government. South Carolina has passed a state counterpart to it called the South Carolina Freedom of Information Act. It is a series of laws designed to guarantee that the public has access to public records of governmental bodies in South Carolina. In addition, the USCIS has its own procedure to access its records through a FOIA/PA Request.
Generally, to get information, you simply make a request (FOIR). There usually is no specific form needed. It must just be in writing, describe with certainty the information you need to access, and comply with that specific agency's requirements. Requests can be made on any agency's records, though some will be either redacted or not complied with for national security or other reasons of a sensitive nature.
Filings and responses are best done electronically, with responses often taking a month or more. Sometimes a first response asks for a narrowing of the scope of the inquiry.
